01About Elea Travel Ltd
Elea Travel Ltd ("Elea", "we", "us") is a private safari intelligence firm that designs and arranges bespoke journeys across East Africa for private clients. By using our website or submitting an enquiry, you agree to these Terms and Conditions.
02Enquiries and Proposals
Submitting a journey enquiry through our website does not constitute a booking or create a contractual obligation on either party. All proposals prepared by Elea are indicative and subject to availability, confirmation, and the execution of a separate Booking Confirmation document.
Proposals remain valid for 14 days from the date of issue unless otherwise stated. Lodge availability, rates, and itineraries may change. Elea is not liable for changes that occur prior to a confirmed booking.
03Bookings and Confirmation
A booking is confirmed only when:
- A Booking Confirmation document has been issued by Elea
- A signed copy has been returned by the client
- The required deposit has been received by Elea
Specific payment terms, deposit amounts, and balance due dates are set out in the Booking Confirmation document and form part of the contract between the client and Elea Travel Ltd.
04Pricing
All prices quoted are in United States Dollars (USD) unless otherwise stated. Prices are based on rates available at the time of proposal and are subject to change until a booking is confirmed. Elea reserves the right to revise prices prior to confirmation if lodge or supplier rates change.
Published prices on our website, if any, are indicative only and do not constitute a binding offer.
05Cancellations and Changes
5.1 Cancellation by the Client
Cancellation terms are specified in the Booking Confirmation document. In general:
- Cancellations more than 90 days before departure: deposit forfeited
- Cancellations 60–90 days before departure: 50% of total journey cost
- Cancellations within 60 days of departure: 100% of total journey cost
We strongly recommend that all clients obtain comprehensive travel insurance that covers cancellation for any reason.
5.2 Changes by the Client
Requests to change confirmed bookings are subject to availability and may incur additional costs. Elea will make every effort to accommodate changes but cannot guarantee them.
5.3 Cancellation by Elea
In the unlikely event that Elea is required to cancel a confirmed booking due to circumstances beyond our control (force majeure, supplier failure, safety concerns), we will offer an alternative journey of equivalent value or a full refund of monies paid to Elea. Elea is not liable for any consequential costs including flights, visas, or insurance premiums.
06Elea's Role
Elea acts as an agent and consultant in arranging travel services provided by independent third parties including lodges, camps, airlines, and ground operators. Elea is not the provider of these services and does not assume liability for their acts, omissions, or defaults.
07Health, Safety, and Travel Documents
Clients are responsible for ensuring they hold valid passports, visas, and any required health documentation for all destinations on their itinerary. Elea will provide general guidance but cannot be held responsible for any client's failure to comply with entry requirements.
Safari travel carries inherent risks. Clients participate in all activities at their own risk and are advised to follow safety briefings provided by guides and lodge staff at all times.
08Travel Insurance
Comprehensive travel insurance is a condition of booking with Elea. Coverage must include medical evacuation, trip cancellation, and personal liability. Elea reserves the right to request evidence of insurance prior to final confirmation.
09Force Majeure
Elea is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disaster, pandemic, civil unrest, government action, or airline failure. In such circumstances, Elea will use reasonable endeavours to offer alternatives.
10Limitation of Liability
To the fullest extent permitted by law, Elea's total liability to any client shall not exceed the total amount paid by that client to Elea for the journey in question. Elea is not liable for indirect, consequential, or incidental losses.
11Intellectual Property
All content on the Elea website, including text, design, photography, and brand elements, is the property of Elea Travel Ltd and may not be reproduced, distributed, or used without prior written permission.
12Governing Law
These Terms and Conditions are governed by the laws of Kenya. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Kenya, without prejudice to your rights as a consumer under the laws of your country of residence.
13Changes to These Terms
Elea reserves the right to update these Terms and Conditions at any time. The current version will always be published on our website. Bookings are governed by the Terms in force at the time the Booking Confirmation is issued.
